Description Implementation of a different legal framework in various self - governing territory may lead to a disparity in development. Disparity in development can affect al l territory or just concrete economic sector, which is changed by new legal framework. Inappropriate choice of regulation or total absence of it can be source of stagnation or destruction of whole sector. This a rticle focus on case study from the middle of nineteenth and early twentieth centuries, which shows a different transformation of contribution funds in territory of Bohe mia, Moravia and Silesia. The "t erritory constitution of Bohemia" supported immediate transformation of funds into capital by territ ory act. Transformed funds were available to landowners, farmers and other agriculturalist in form of loans with low interest rate. In Moravia and Siles ia territory was missing legal f ramework for this transformation. Because of this situation most of the money stay ed in old funs without any benefit for locals. This implicated difficult access to capital for agriculturist. Visible homogenization of retail banking sector in Czech lands at the beginning of the twentieth century was cause of active private sec tor. In the territory of Moravia and Silesia active private sector overcame lack of legal framework and found way to provide access of capital to agriculturist. In this article we found situation where private sector replaces failing public sector. This ex ample from history can be analogous to the disparity of development in territories of self - governing units or states.
