Description The article describes the legal regulation of both employment contract and employment relationship as it was reflected in the provisions of the 1950 Civil Code and the 1965 Czechoslovakian Labour Code. With support of archive materials, the author provides an insight even into the rarely known first period of preparatory works on the Labour Code (covering years 1949-1950), the so called právnická dvouletka. At the end of this regulatory process, completed by enacting the Labour Code, the legal institute of employment contract was overshadowed by the latter one - employment relationship. As a result of the growing protective tendencies towards workers, the initial liberal concept of employment contract set by the 1811 Civil Code (ABGB) turned into the opposite extreme. Over-protection of workers has blocked their mobility and effective use of their work potential.
