Description The contribution is focused on Roman law aspects in the legal regulation of a gaining ownership right by an accession by building. This type of accesion is in literature called as „inaedificatio“. It can be defined as the accession that is based on the human will. The aim of the authoress of this contribution will be to point out the typical characters of a gaining ownership right to the building in new Civil code. As a result of a renewal of principle „superficies solo cedit“ is new legal regulation different from previous civil codes.
